There is much to consider and prepare before you and your property are ready to find a tenant. We can guide you through all the regulations, tenant referencing, obtaining permissions to let, tenancy agreements and more.
Landlords are required by law to provide an Energy Performance Certificate (EPC) for all rented property with new tenants, and it is best practice not to market your property until this has been ordered. The EPC gives prospective tenants information on the energy efficiency and carbon emissions of a property.
It is a legal requirement that the gas supply and any appliances provided by the landlord are checked annually by a GAS SAFE registered gas installer and a Landlords Gas Safety Certificate is issued. Your tenant cannot move in until this has been provided.
On 1st June 2020 the government brought in new regulations for electrical safety standards in the private rented sector, these new Regulations require landlords to have the electrical installations in their properties inspected and tested by a person who is qualified and competent, at least every 5 years. Landlords must provide a copy of the electrical safety report to their tenants, and to their local authority if requested.
All upholstered furniture and soft furnishings provided by the landlord of a rented residential property must comply with the Fire and Furnishings (Fire) (Safety) Regulations 1988. It is also advisable to install at least one battery operated smoke alarm on each floor of your property if a mains operated alarm cannot be fitted.
The Renters' Rights Act 2025 (receiving Royal Assent in Oct 2025 and coming into force for private tenancies on 1 May 2026) aims to overhaul the private rented sector, strengthening tenant security and safety. Key reforms include abolishing Section 21 'no fault' evictions, ending rental bidding wars, and implementing a new Ombudsman.
Key Changes for Tenants & Landlords (Effective 1 May 2026):
- End of 'No Fault' Evictions: Section 21 evictions are abolished to provide greater stability, allowing renters to stay in homes longer.
- End of Fixed-Term Contracts: All tenancies will transition to assured periodic (rolling) tenancies.
- Rent Control Measures: Only one rent increase per year is allowed, and landlords are prohibited from demanding excessive rent in advance.
- Pet Policies: Tenants have the right to request a pet, which landlords cannot unreasonably refuse.
- Standardized Quality: Introduction of a new landlord ombudsman, a new Private Rented Sector (PRS) database, and stricter standards for home safety (Awaab's Law).
